Accessing the Application

Upon Initial Use

The first time you start Mood, you will be walked through the basic settings. You will set how
often and when exactly Mood should ask you for your physical and mental state. Different settings can be used during the workweek and on weekends.

Mood Home Screen

You have two options to choose from on the main screen. You can analyze your existing records
by tapping “Analysis” or change your settings by simply tapping “Settings”.

Analysis

Mood Analysis

mood gives you the opportunity to analyze your physical and mental state flows throughout the day, week, month and year. Simply switch between timespans using the buttons above. You can then scroll between curves by swiping, hide and show individual curves by simply tapping on the corresponding legends.

Mood Settings

You can modify your settings anytime by tapping “Settings” on the home screen. This will take
you to the options screen introduced the first time you launched Mood. You will have the chance
to modify how often and when exactly Mood will ask you for your physical and mental state.

Privacy policy

JeTi s.r.o. ("Provider") is dedicated to protecting the privacy rights of Mood’s online Users ("User/Users"). This Online Privacy Policy ("Privacy Policy") has been crafted to inform the Users as to the ways information provided by the Users in connection with Mood (“Service”) is collected, stored, and managed. Please note that the scope of this Privacy Policy is limited to only information collected through use of the Service.

By using the Service, the User agrees to the collection and use of his/her personal information as outlined in this Privacy Policy. The Provider may amend the Privacy Policy from time to time, and the User is encouraged to consult the Privacy Policy regularly for changes.

Information Collected and Used

The Provider's primary objective in collecting user information is to ensure Service can be easily navigated and enjoyed by Users. No User information is collected by Provider except items outlined in Section “Third-Party Advertising Companies” later in this document.

Information about the User may be disclosed to the Provider’s partners in order to resolve Service problems, correct errors in the Service and to communicate with the User about the Service. However, the Provider does not give his partners an independent right to share this information. Users can opt-out of sharing information through informing the Provider in writing. However, this may result in Provider not being able to resolve Service problems.

In all cases of data access and collection, information the User provides will not be disclosed, rented, leased, loaned, sold, or otherwise voluntarily distributed to unaffiliated third parties and will be used solely for the purpose of resolving Service problems.

Other Disclosure of the User’s Personal Information

The User understands and agrees that the Provider may be required to disclose any personal information if required to do so by law or in good faith believes that such disclosure is reasonably necessary to avoid liability, to comply with legal process, including but not limited to a search warrant, subpoena, statute, or court order, or to protect the Provider’s rights and property, or that of the public. Note that the Provider is not required to question or contest the validity of any search warrant, subpoena or other similar governmental request that he may receive.

Additionally, in the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, customer information may be transferred to the Provider's successor or assignee, if permitted by and done in accordance with applicable law.

Others’ Information

The User may decide to supply the Provider with another person’s personal information such as email address so that the person may be invited to join the Service. The Provider uses this information to contact and, if necessary, remind that person that he/she has been invited to join the Service or receive content from the Service. The Provider may disclose such information if required to do so in order to comply with legal process, as described above.

Links

The Service may contain links to other websites. The fact that the Service links to a website or presents a banner ad or other type of advertisement does not mean that the Provider endorses or authorizes that third party, nor is it a representation of the Provider’s affiliation with that third party. The Provider is in no way responsible for the privacy policies of these other websites to which the User chooses to access from the Service. The User is advised to be sure to read the privacy policies of those websites when exiting the Service.

Third­Party Advertising Companies

Third-party advertising companies may be used by to serve ads on the Service. The Provider does not provide any personal information to third-party advertising companies on a non-aggregate basis. The Provider’s system and the third-party advertising technology may use aggregate information, non-personal information, the Provider’s cookies on the User’s hard drive and the User’s use of the Service to target advertisements. In addition, advertisers may use other third-party advertising technology to target advertising on other sites. If advertisements are served to the User, a unique third-party cookie or cookies may be placed on the User’s computer. Similarly, third-party advertising companies may supply the Provider with pixel tags (also called “clear gifs” or “beacons”) to help manage and optimize online advertising. Beacons enable the Provider to recognize a browser’s cookie when a browser visits the site on which the beacon is located, and to learn which banner ads bring Users to a given site.

Security

Reasonable technical and organizational measures have been put in place designed to secure the User’s personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, the Provider cannot guarantee that unauthorized third parties will never be able to overcome those measures or use the User’s personal information for improper purposes. Also Users are advised to note that email and messaging systems are not considered secure, so they are discouraged from sending the Provider personal information through these mediums.

Policy Regarding Children

The Service is not geared towards children under the age of 13 and the Provider does not knowingly collect personal information from children under the age of 13. If the Provider learns that a child under 13 has supplied the Provider with personal information such information will be deleted from the Provider’s files as soon/fast as possible.

Terms of use

Accepting the Terms

These  Terms  of Service  ("Terms")  are a legal  agreement  between  JeTi s.r.o.  ("Provider")  and Users ("User/Users")  of  the  application  Mood  (“Application”).  By  using  or  accessing  the Application    the  User agrees to be bound by these terms. The Provider’s Privacy Policy is incorporated herein by reference. By accessing  or  using  the Service,  the  User  agrees  that  he/she  has read,  understood,  and  accepted  to  be bound by the Terms. The Provider reserves the right, in its sole discretion, to modify or revise these Terms at any time, and the User agrees to be bound by such modifications or revisions. If the User does not agree to the Terms, he/she is not permitted to use the Service. The User is responsible for periodically viewing the Terms. The User’s continued use of the Service after a change or update has been made will constitute his/her acceptance to the revised Terms. If the User does not agree to the Terms his/her only remedy is to discontinue his/her use of the Service and cancel any accounts he/she has made using the Service. If the User violates the Terms, the Provider reserves the right to issue the User a warning regarding the violation or immediately terminate or suspend any or all accounts the User has created using the Service. The User agrees  that  the  Provider  need  not  provide  the  User  notice  before  terminating  or  suspending  his/her account(s), but he may do so. The Provider reserves the right to refuse any user access to the Services without notice for any reason, including, but not limited to, a violation of the Terms. The User agrees that the Provider may discontinue the Service or change the content of the Service at any time, for any reason, with or without notice to the User, without liability. The User represents that he/she is 13 years old or older. If the User is between the ages of 13 and 18, he/she represents that his/her legal guardian has reviewed and agrees to the Terms.

Intellectual Property/Ownership

All  materials  that  are  part  of  the  Service  (including,  but  not  limited  to,  designs,  text,  graphics,  pictures, video,  information,  applications,  software,  music,  sound  and  other  files,  and  their  selection  and arrangement)  are  protected  by  law  from  unauthorized  use.  The  entire  contents  of  the  Service  are copyrighted under the copyright laws of the Czech Republic and/or similar laws of other jurisdictions. The User  agrees  that  no  materials  that  are  part  of  the Service  may  be  modified,  copied,  distributed,  framed, reproduced, republished, downloaded,  scraped, displayed, posted, transmitted, or  sold in any form or by any  means,  in  whole  or  in  part,  or  otherwise  exploited  without  the  Provider's  express  prior  written permission. All other uses of copyrighted material, including any derivative use, require express prior written permission from the Provider. Any reproduction or redistribution of materials not in accordance with these Terms is explicitly prohibited and may result in severe civil and criminal penalties. The Provider and/or his licensors remain the owners of right, title, and interest, including copyrights and other intellectual property rights, in and to all materials posted on the Service by the Provider. The User acknowledges that he/she does not acquire any ownership rights by using the Service or by accessing any materials posted on the Service  by  the Provider,  or  any  derivative works  thereof. The Provider  grants  the User  a  personal,  non­ exclusive, non­transferable, revocable, limited  scope license to use the Service  solely for the purpose of viewing and using the applicable Services and for no other purpose whatsoever. The User’s license to use the Services is limited by these Terms.

Rules of Conduct

The  Service  may  provide  Communication  Channels  such  as  forums,  communities,  or  chat  areas ("Communication Channels") designed to enable the User to communicate with other Service Users. The Provider has no obligation to monitor these Communication Channels but may do so and reserves the right to review materials posted to the Communication Channels and to remove any materials, at any time, with or  without  notice  for  any reason,  at  its  sole  discretion. The Provider  may  also  terminate  or  suspend  the User’s  access  to  any  Communication  Channel  at  any  time,  without  notice,  for  any  reason.  The  User acknowledges  that  chats,  postings,  or  materials  posted  by  Users  on  the  Communication  Channels  are neither  endorsed  nor  controlled  by  the  Provider,  and  these  communications  should  not  be  considered reviewed  or  approved  by  the  Provider.  The  Provider  will  not  under  any  circumstances  by  liable  for  any activity  within  Communication  Channels.  The  User  agrees  that  all  his/her  communications  with  the Communication Channels are public, and thus has no expectation of privacy regarding his/her use of the Communication Channels. The Provider is not responsible for information that the User chooses to share on the Communication Channels, or for the actions of other Users. The User agrees that his/her use of the Service shall be lawful and that the User will comply with the usage rules.

Privacy and Protection of Personal Information

Information collected from the User is subject to the pertinent social network's policy. By using the Service, the User may be granting his/her social network permission to share his/her e­mail address and any other personally identifiable information with the Provider. The User is requested to  see the Provider's Privacy Policy  for  more  information  on  the  collection  and  use  of  user  information.  The  User  acknowledges  and agrees that the Privacy Policy is incorporated and made part of these Terms.

Disclaimer of Warranty; Limitation of Liability

The User agrees that his/her use of the Service shall be at his/her sole risk. To the fullest extent permitted by  law,  the  Provider,  its  subsidiaries,  affiliates,  officers,  directors,  employees,  and  agents  disclaim  all warranties,  expressed  or  implied,  in  connection  with  the  website  and  the  User’s  use  thereof  including implied warranties of title, merchantability, fitness for a particular purpose or non­infringement, accuracy, authority, completeness, usefulness, and timeliness. The Provider makes no warranties or representations about the accuracy or completeness of the content of the Service and of the content of any sites linked to the Service; the Provider assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from the User’s access to and use of the Service, (iii) any unauthorized access to or use of the Provider’s secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of  transmission  to  or  from  the  Service,  (v)  any  bugs,  viruses,  Trojan  horses,  or  the  like  which  may  be transmitted to or through the Service by any third party, and/or (vi) any errors or omissions in any content or for  any  loss  or  damage  of  any  kind  incurred  as  a  result  of  the  use  of  any  content  posted,  emailed, transmitted,  or  otherwise  made  available  via  the  Service.  In  no  event  will  the  Provider,  its  subsidiaries, affiliates, directors, officers, agents, contractors, partners and employees, be liable to the User or any third person for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever including any  lost  profits  or  lost  data  arising  from  the  User’s  use  of  the  Service  or  other  materials  on,  accessed through or downloaded from the Service, whether based on warranty, contract, or any other legal theory, and  whether  or  not  the  Provider  has  been  advised  of  the  possibility  of  these  damages.  The  foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. The User specifically  acknowledges  that  the  provider  shall  not  be  liable  for  user  submissions  or  the  defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with the User. The User agrees to indemnify and hold the Provider, and each of his subsidiaries, affiliates, directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney's fees, arising out of or in connection with (i) the User’s use of and access to the Service; (ii) the User’s violation of any term of these Terms of Service; (iii) the User’s violation of any third party right, including but not limited to any  copyright,  property,  or  privacy right; (iv)  any  claim  that  one  of  the  User’s  user  submissions  caused damage to a third party; or (v) any Content the User posts or shares on or through the Service.

General

By  visiting or using the Service, the User agrees that the laws of the Czech Republic, without regard to principles of conflict of laws and regardless of the User’s location, will govern these Terms of Service and any dispute of any sort that might arise between the User and the Provider. Any claim or dispute between the User and the Provider that arises in whole or in part from the User’s use of the Service shall be decided exclusively  by  a  court  of  competent  jurisdiction  located  in  the  Czech  Republic,  and  the  user  hereby consents to, and waives all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the Czech Republic. The Provider reserves the right to amend these Terms of Service at any time and without notice, and it is the User’s responsibility to review these Terms of Service for any changes. The User’s use of the Service following any amendment of these Terms of Service will signify the User’s assent to and acceptance of its revised terms. THE USER AND THE PROVIDER AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
